TBA Member Bobby Long
Warns of Builder Liabilities

Florida courts are always inclined to allow law suits to proceed, even in the face of statutes the Legislature has crafted to stop them.  Florida law provides that lawsuits alleging a construction defect must be filed within four years of the date of the issuance of a certificate of occupancy or completion of the contract between an engineer, architect, or contractor.  If the defect is "latent" then an owner has ten years.  The Legislature created these limits to provide some peace to builders with the passage of time.  But on November 8, 2013, a Florida Appellate Court held that the Clearwater Housing Authority could bring an action against design professionals even though it had been eleven years since the certificate of occupancy was issued.  The court based their decision on arguably unrelated survey work completed eight years before suit.  The lesson learned is an old one – Florida courts will construe statutes in a way that allows litigation wherever they can.  Practically it means the legislature's intent to provide peace through the passage of time can be illusory in the hands of Florida judges.  – TBA Member Bobby Long, Rumberger, Kirk & Caldwell, P.A., Tallahassee ().

Doug Barton Will Chair
2014 Parade of Homes™

The Tallahassee Builders Association has selected one of its most decorated members – Doug Barton, CIP, CAPS, of Barton Construction – to Chair the 2014 Parade of Homes™, TBA’s signature annual event.  “I am thrilled to be heading up the Parade of Homes™,” said Barton, “in large part because I know how much it means to our community and all the TBA members who use the Parade to showcase their skills new homes and all the many products and services that combine to create great lifestyles.”

Born and raised in Tallahassee, Barton’s love for Florida’s capital city has evolved over the years into a deep-rooted appreciation for the all of the unique characteristics that make our town so remarkable. A graduate of both Florida State and Auburn University, Barton spent several years learning the fundamentals of architectural integrity.

Today, after over a decade of sound and successful business practices, his influence and classic craftsmanship can be seen throughout Leon County, including in the popular Southwood and Midtown communities. With the assistance of wife Lisa Barton, also an FSU graduate, Barton Construction is widely recognized throughout the region for fusing the historical context of southern architecture with the aesthetic value of modern amenities and construction.

Barton’s custom homes have been consistent winners in the parade over the years, including the Best of Show in 2012. He holds the professional designations of Construction Industry Professional (CIP) and Certified Aging in Place Specialist (CAPS), respectively earned from TBA and the National Association of Home Builders (NAHB).

For this year’s Parade of Homes – scheduled over the weekends of May 10-11 and May 17-18 – Barton is focusing on bringing the TBA to the public in unparalleled ways.

“The Parade of Homes is a vital component to a complete marketing plan in the residential arena,” stated Barton. “I’m truly looking forward to helping the TBA showcase our incredibly talented local builders and their products with this event. I’m also excited to involve the public not just as viewers, but as participants. They are our critics as well as our patrons. This event can and should be a community affair.”

Barton said he expects 35 to 40 homes in the Parade and noted his Parade Committee is drawing on the experience of recent Parade Chairs Mark Worley, CIP, GMB, of Worley Construction and Thomas Asbury, Jr. of Premier Fine Homes.

TBA Friend Ray Burroughs
Has Havana Home for Sale

Retired local building official Ray Burroughs remains a friend to the Tallahassee building community so TBA is happy to pass along news of a home in Havana that Ray is trying to sell. Ray’s family inherited an older home in downtown Havana (121 6th Ave East, across the street from the Baptist church). He would like to sell the home to a builder-investor who would fix it up to rent or resell. The home is 1,823 square feet of conditioned space; 1,977 square feet under roof; 3 bedroom 2 bath; new architectural shingles a few years ago; aluminum siding; wood floors; and central HVAC. The house needs mostly superficial work (interior painting, new kitchen cabinets, new fixtures in one bathroom and a couple of new windows).  The suggested price of $80,000 is negotiable. If you are interested, contact Ray at his home number 893-3395 or mobile 661-6533.
